Terms of Service

Golden Catalyst LLC (“Golden Catalyst,” “we,” “us,” or “our”) operates HeartSpark™, Ignite™ Platform, BehaviorStack™, and related Services. HeartSpark™ is a communication-assistance and relationship-focused application operating within the Ignite™ Platform ecosystem. All Services are provided by Golden Catalyst LLC, a Florida limited liability company.

1. Acceptance of Terms

By accessing or using HeartSpark™ or related Services, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not access or use the Services.

2. Eligibility

You must be at least 18 years old, possess the legal authority to enter into binding agreements, and comply with all applicable laws and regulations. By using the Services, you represent and warrant that you satisfy these requirements.

3. Accounts & Authentication

Certain Services require account registration. Users are responsible for maintaining confidentiality of credentials, safeguarding authentication information, all activity occurring under their accounts, and maintaining accurate account information. HeartSpark™ may utilize centralized authentication or unified account systems provided through Ignite™ Platform. We reserve the right to suspend, restrict, or terminate accounts at our discretion.

4. Acceptable Use

Users agree not to violate laws or regulations, harass, abuse, threaten, stalk, or harm others, generate deceptive or illegal content, impersonate individuals or entities, misuse communication tools, reverse engineer systems, scrape data or models, overload infrastructure, bypass security measures, or misuse AI-generated outputs. Unauthorized use may result in suspension, termination, or legal action.

5. AI-Generated Communication Content

HeartSpark™ may generate communication suggestions, conversation starters, behavioral insights, message recommendations, personalization outputs, and AI-assisted communication content. AI-generated outputs may contain inaccuracies, may produce unexpected results, may vary depending on user input, and are probabilistic in nature. Users are solely responsible for evaluating generated outputs, reviewing communications, exercising independent judgment, and determining whether generated content is appropriate for use.

6. Relationship & Emotional Disclaimer

HeartSpark™ is intended for informational, communication-assistance, productivity, personalization, and entertainment purposes only. HeartSpark™ does not provide relationship counseling, psychological counseling, mental health services, crisis intervention, emotional dependency services, or professional therapy. Golden Catalyst LLC makes no guarantees regarding relationship outcomes, emotional outcomes, communication success, compatibility, interpersonal results, or behavioral predictions. Users are solely responsible for their interactions, decisions, communications, and relationships with others.

7. Behavioral Intelligence Systems

BehaviorStack™ is a proprietary behavioral intelligence framework developed and operated by Golden Catalyst LLC. BehaviorStack™ technologies may analyze communication patterns, contextual signals, interaction tendencies, engagement metrics, behavioral patterns, and platform activity to improve personalization, communication assistance, and probabilistic relevance. These systems are designed to improve user experiences, not to manipulate users or guarantee outcomes.

8. Payments & Subscriptions

Certain Services may require subscriptions, credits, premium access, or usage-based billing. All purchases are final unless otherwise stated. Credits have no cash value, are non-transferable, and may expire. Pricing may change at any time with reasonable notice.

9. Intellectual Property

All platform technology, software, AI systems, behavioral intelligence frameworks, branding, infrastructure, algorithms, personalization systems, and related intellectual property remain the property of Golden Catalyst LLC or its licensors. BehaviorStack™ and Ignite™ are trademarks of Golden Catalyst LLC. Users receive only a limited, revocable, non-transferable license to use the Services in accordance with these Terms.

10. User Content

Users retain ownership of submitted content. By using the Services, users grant Golden Catalyst LLC a limited, non-exclusive, worldwide license to process, analyze, store, transmit, and utilize submitted content solely for operating the Services, generating AI outputs, maintaining functionality, improving systems, maintaining security, and improving user experiences.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN CATALYST LLC DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AND AVAILABILITY. We do not guarantee uninterrupted or error-free operation of the Services.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN CATALYST LLC SHALL NOT BE LIABLE FOR INDIRECT DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, LOSS OF DATA, EMOTIONAL DISTRESS, RELATIONSHIP OUTCOMES, COMMUNICATION FAILURES, OR RELIANCE ON AI-GENERATED OUTPUTS. Use of the Services is at the user’s own discretion and risk.

13. Arbitration & Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes arising from the Services shall be resolved through binding arbitration in Florida, except where prohibited by law. Users waive participation in class-action lawsuits or class-wide arbitration.

14. Termination

We may suspend, restrict, or terminate access to the Services at any time, with or without notice, for any reason including violations of these Terms, misuse of the Services, harmful conduct, security concerns, or operational risks.

15. Changes to These Terms

We may update these Terms periodically. Continued use of the Services after updates constitutes acceptance of the revised Terms.
